A woman from Atherton has been evicted from her council home for anti-social behaviour.
Carol Ann Fahy, of 21 Spring Gardens, was evicted this week (Monday 13th February), following legal action by landlord by Wigan & Leigh Housing.
Neighbours had experienced nuisance and intimidation since 38 year old Fahy moved into the property in July 2004. Ms Fahy had regular 'undesirable' visitors to her property, who verbally abused, intimidated and threatened her neighbours. Wigan & Leigh Housing was forced to seek an injunction against one of these visitors, Darren Lee, to keep him away from the area. He had been writing obscene graffiti outside the block and had threatened the neighbours with violence.
Wigan & Leigh Housing began possession proceedings against Ms Fahy in November 2005. Ms Fahy ignored a seven day possession order granted by Leigh County Court on 25th January, leaving Wigan & Leigh Housing no option but to apply for an eviction warrant.
In addition, Mr Lee breached his injunction by visiting Spring Gardens on two occasions, the latest incident being the day of Ms Fahy's eviction. He was immediately sentenced to 28 days imprisonment by Liverpool County Court.
Peter Gee, Chief Executive of Wigan & Leigh Housing says:
"We don’t want anyone to be evicted, but Ms Fahy's behaviour, and that of her visitors, gave us no alternative.
"We won't tolerate this kind of behaviour and its effect on our tenants in their homes. With all kinds of dubious characters calling at 21 Spring Gardens at all hours of the day and night, it quickly became apparent that the neighbours could not continue suffering from this nuisance and intimidation.
"I would like thank all those residents who, despite continuing problems, had the courage to support us and the police by giving evidence against the people who were damaging their neighbourhood.
"Wigan & Leigh Housing is committed to taking action against any individual whose behaviour has a detrimental effect on the wider community. Our warnings and threats will be backed up with legal action if necessary."
